1. Acceptance of the Terms
Use of or access to colombiahairtransplant.com or requesting a quotation or any services offered by Colombia Hair Transplant (“Company”) shall constitute acceptance of these Terms and Privacy Policy. In contrast, unwillingness to accept every provision shall require you not to use or access any service or the Site of the Company.
2. Company Role and Scope of Services
The Company is a Bogota-based medical-travel facilitator. It coordinates hair-restoration procedures performed by independent licensed surgeons and clinics in Bogota, Medellin, and Cali and provides related logistics such as accommodation, ground transport, and translation. The treating clinic or doctor takes full responsibility for medical care; the Company is there just for facilitation and customer service.
3. Eligibility and Patient Responsibilities
You confirm that you are eighteen (18) years of age or older, able to enter binding contracts from a legal standpoint, medically fit to travel, are willing to disclose full, truthful information concerning your health, and intend to follow pre-operative and post-operative instructions. You also understand that you will require travel documents, vaccinations, and insurance.
4. Privacy and Data Use Policy
a. Personal Data Collected – Full name, address, phone, email, photos of hair or scalp, medical details, and travel preferences (collectively referred to as “Information”).
b. Purpose of Collection – To assess your suitability, communicate with you, arrange for your treatment, and provide post-operative care.
c. Data Handling – The information is treated as confidential, stored in a secure manner, and disclosed only to relevant Company employees and partner service providers (clinics, hotels, transport) for fulfilling their service obligations toward you. These providers are made aware of their obligation to maintain confidentiality.
d. No Sale of Data – The Company does not sell, rent, or otherwise disclose any personal data to unauthorised third parties.
e. Retention and Deletion – Information is retained for treatment, follow-up, and legal compliance needs. You may request deletion after follow-up has been finalised, unless Colombian law obliges further retention.
f. Legal Disclosure – Disclosure of information may only be required by Colombian law, court order, or regulatory request.
By using the Site or services, you consent to the collection and use of your Information.
5. Medical Disclaimer
Website content and communications from the Company are for general purposes of information only and are not intended as a substitute for a personal consultation with a qualified physician. Every situation is different; individual medical decisions must be made in conjunction with a licensed surgeon. The Company strongly recommends a thorough virtual or in-person consultation prior to arranging for surgery. Responsibility for the ultimate determination of candidacy, treatment plan, and medical outcomes rests with the treating surgeon, the disclosure of your medical history, and the accuracy thereof.
6. Consultation and Informed Consent
Eligibility, graft count, and technique may finally be agreed upon by the operating surgeon after physical or virtual evaluation. You must go through the clinic’s informed-consent documents and sign them prior to any intervention.
7. Booking, Estimates, and Payment
The prices provided from photos and preliminary information serve only as good-faith estimates. After on-site assessment, graft counts, medications, taxes, and selected upgrades will determine the final charges. In some cases, a non-refundable booking fee is required, with the remaining balance payable early in the morning on the surgery day. Accepted currencies are USD and Colombian pesos or any other payment expressly authorized by the Company.
8. Cancellations, Rescheduling, and Refunds
• For cancellations or rescheduling more than fourteen (14) days prior to surgery: the prepaid balance, minus the booking fee, may be refunded or applied toward a new date.
• For cancellations or rescheduling fewer than fourteen (14) days prior to surgery: up to fifty percent (50%) of the package price may be forfeited as rooms in the operating theaters, hotel nights, and staff have been reserved.
9. Travel and Accommodation
International airfares shall not be part of the package unless explicitly stated. If the Company books hotels, transporters, or other services for the Client, it will do so as an agent only; each supplier renders services under its own terms. You are responsible for obtaining entry into Colombia and for obtaining adequate travel and medical insurance.
10. Risks of Procedure and Patient Obligations
FUE hair transplant is usually safe. However, there are surgical risks such as infection, bleeding, scarring, delayed healing, and variable hair growth. By consenting, you acknowledge such risks and further agree to abide by the following:
a) strictly follow all medical instructions;
b) abstain, when directed, from smoking or drinking alcohol;
c) attend all scheduled follow-ups; and
d) report any atypical symptoms as soon as they appear.
11. Disclaimer Regarding Results
Photographs and testimonials on the Site depict typical results but are in no way guarantees. Outcomes vary with genetics and donor-hair quality, healing time and methods, and after-care compliance, as well as other lifestyle considerations such as age, smoking habits, and personal health. It may be that lighting and styling are different in certain images, but there have never been digital alterations beyond cropping or a light adjustment. Hair restoration is a slow process; therefore, patience is required. No promises of any given density, coverage, or aesthetic outcome can be made.
12. Terms and Intellectual Property Associated with Website Use
All text, images, graphics, and logos appearing on the Site belong to the Company or are otherwise used with permission. Anyone may not reproduce, duplicate, redistribute, or create derivative works based on them without prior written consent. The information is offered “as is,” with no warranty concerning its accuracy or completeness, and you assume all risks in relying upon outdated or incorrect information. This Site may contain links to other websites for your convenience; the Company does not hold responsibility for such external Web content.
13. Prohibited Uses
You undertake not to:
a) bypass any Site security measures or attempt to gain unauthorized access to data;
b) upload, transmit, or facilitate transmission of unsolicited bulk messages or harmful codes such as viruses;
c) scrape, harvest data, or otherwise engage in any automated data collection or extraction methods;
d) impersonate another person or entity; or
e) use the Site or the services for any unlawful, fraudulent or abusive purposes.
14. Limitation of Warranties
The services and contents are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Company makes no express warranties and no implied warranties of merchantability or fitness for a particular purpose, or title, or non-infringement.
15. Limitation of Liability
To the maximum extent permitted by Colombian law, the Company shall not be held liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including the loss of profits, revenue, data, or goodwill, even if it has been informed of the possibility of such damages. Total liability shall not exceed the amount you paid directly to the Company for the facilitation service giving rise to the claim.
16. Indemnification
You hereby agree to indemnify, defend, and hold harmless the Company, its owners, employees, and agents from any claims, damages, costs, or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, negligence, or wrongful conduct.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the Republic of Colombia. Any dispute shall be finally resolved by the courts of Bogotá D.C., and you consent to personal jurisdiction before such courts.
18. Dispute Resolution
Prior to the institution of any litigation, you shall notify the Company and the parties shall attempt in good faith to resolve the dispute for at least thirty (30) days informally. If the dispute remains unresolved, the parties agree to non-binding mediation in Bogotá before commencing court proceedings.
19. Changes to These Terms
The Company reserves its right to periodically update these Terms. The date indicated as the ‘Last Updated’ shall change whenever a new revision is published. Any further use of the Site or services after such modification shall be deemed your acceptance of the new Terms.
